27.04.2010 A new world record: Universal Declaration in 370 languages

The Universal Declaration of Human Rights has set a new world record of being the most translated text. The UN Human Rights office has received a certificate from the Guinness Book of Records stating that the Declaration has been translated into in 370 languages and dialects from Abkhaz to Zulu.

23.03.2010 Cudak v. Lithuania (application no. 15869/02)

The case concerned an application brought by a Lithuanian national, Alicija Čudak, who was born in 1961 and lives in Vilnius. In 1999, Ms Čudak complained to the Lithuanian Equal Opportunities Ombudsperson that she was being sexually harassed by one of her male colleagues as a result of which she had fallen ill. The Ombudsperson held an inquiry and recognised that she was indeed a victim of sexual harassment.

The European Commission against Racism and Intolerance (ECRI) published a new report on Estonia yesterday, examining racism, xenophobia, antisemitism and intolerance in this country. The Human Rights Centre was consulted for this report by the ECRI delegation that visited Estonia last year.

23.02.2010 Pinkowski v. Poland (application no. 16579/03)

The applicant, Mariusz Pińkowski, is a Polish national who was born in 1970 and lives in Częstochowa (Poland). In March 2000 he was charged with being an accomplice to an armed robbery and murder in France and remanded in custody by the Częstochowa district court. The court justified its decision by the strong evidence against the applicant, the likelihood of a severe sentence of imprisonment being imposed on him if convicted and the risk that he might obstruct the proceedings. During the proceedings, further charges were added, including false imprisonment, torture and being a member of an organised criminal gang. The applicant’s pre-trail detention was upheld by several court decisions, referring to the original grounds for the detention and additionally to the international dimension of the case. In March 2002 the regional court convicted the applicant as charged and sentenced him to twenty-five years’ imprisonment.

18.02.2010 The European Court of Human Rights has today delivered at a public hearing its Grand Chamber judgment1 in the case of Andrejeva v. Latvia (application no. 55707/00).

The Court held by 16 votes to one, that there had been a violation of Article 14 (prohibition of discrimination) of the European Convention on Human Rights in conjunction with Article 1 of Protocol No. 1 (protection of property) to the Convention on account of the Latvian courts’ refusal to grant the applicant a retirement pension in respect of her years of employment in the former Soviet Union prior to 1991 on the ground that she did not have Latvian citizenship; and unanimously, that there had been a violation of Article 6 § 1 (right to a fair hearing) of the Convention.

The European Court of Human Rights published a judgment in the case of Malkov v Estonia, where it found a violation of Article 5 § 3 (right to liberty and security) namely in relation to the excessive length of the applicant’s pre-trial detention.

02.02.2010 Kozak v. Poland (application no. 13102/02)

The European Court of Human Rights published a judgment on the case Kozak v. Poland on the 2nd of February 2010. Relying in particular on Articles 8 and 14, the applicant complained that the Polish courts, by denying him the right to succeed to a tenancy after the death of his partner, had discriminated against him on the ground of his homosexual orientation.The application was lodged with the European Court of Human Rights on 23 August 2001. The Court concluded that there had been a violation of Article 14 taken in conjunction with Article 8.
